Case Study #1: Martin recently became accredited with the Department of Veterans Affairs. Martin is anxious to help his friend Bill who believes he has a disability claim. Martin assists Bill with a claim for disability. This is the first disability claim that Martin has ever done. Martin is successful in getting Bill a 60% rating. Bill is extremely grateful and offers Martin a fee for his services. Martin turns down the fee proposal knowing it's against the rules. A year after receiving the award for 60% disability, Bill & his wife buy a new car. Bill's wife offers Martin's wife the old car as a token of gratitude for Bill's claim. Martin's wife accepts the gift of the old car as a token for assistance with the claim.
Martin becomes very proficient at assisting with claims and even conducts workshops for other accredited claim representatives on how to submit successful claims. Martin is particularly proud of his success with his first claim for Bill and uses all of Bill's VA correspondence including all of Bill's personal information as teaching material for accredited individuals attending the workshops.
About 3 years after the award of his disability claim, rated at 60%, Bill and his wife move to another state. Bill's service-connected condition has worsened and he goes to Sally, an accredited claim representative in his new state, for assistance in applying for an increase of his previously awarded 60%. Sally has previously attended Martin's workshop and recognizes Bill as the example in Martin's workshop teaching material. Sally is concerned about privacy and reports the use of Bill's VA correspondence as a workshop teaching tool to the Office of General Counsel.
