Case Study #4:
Marcia is an accredited claims agent. She has decided that she will assist veterans with appeals. She does not have a source of claimants to assist so she makes an arrangement with a recognized veterans service organization to do appeals for their claimants. In order to make an income while she is waiting for appeals to receive a decision, the local service organization has agreed to hire her temporarily as a claims agent. For this she will also process original claims for the organization as well. For appeals, she has decided to charge 20% of the past-due benefits so that VA will withhold her fees from the award. She also charges for her expenses which she bills separately for collection as VA will not withhold any more than 20%. She also has a side agreement with the claimants that if she helps them with an appeal, she will receive 10% of the ongoing award for a year. She submits the proper fee agreements for the 20% withholding only. She has separate agreements for the ongoing contingency payments as well as for her expenses.
